An
example of agency law (each state has different laws):
As of October 1, 1997, the
new real estate agency law in Florida makes a presumption of non-representation.
Unless you engage a licensee to represent you in a real estate transaction,
you are not represented. This law also creates the role of "transaction
broker". A transaction broker cannot represent one party to the detriment
of the other. Transaction brokers provide limited representation to a buyer,
seller, or both in a real estate transaction, but cannot represent either
in a fiduciary capacity as a single agent.
